Individual Voluntary Arrangement (IVA)
In simple terms, the IVA deals with personal debt often arising as a result of a business failing. An IVA is a contract between an insolvent person and his or her creditors which allows the insolvent person to pay back a proportion of their current debts out of future earnings. This allows the individual to avoid bankruptcy and to continue in business. The creditors have a proportion of their debt honoured rather than potentially lose out completely should the individual be made bankrupt.
In order for an IVA to be feasible, the individual must display the potential to generate an income stream either from regular employment or from their business. Self employed people would use our Business MedicalTM process to establish business viability Once done so then a proposal is offered to the various creditor parties to pay back a proportion of existing debts over a period of time, usually five years. Such an arrangement may instantly improve cash flow and alleviate the mounting pressure on the individual and the business.
The IVA process must be run by a licensed Insolvency Practitioner; our partners are Baker Tilly and T H Associates.However it may be possible for Business Rescue Limited to negotiate an informal arrangement with the support of key creditors using a Debt Management plan.
